terms and conditions

article 2 - applicability & conditions 

2.1 These general conditions of sale apply to all transactions with the webshop or the store "the baby's corner" (hereinafter referred to as "the baby's corner") and anyone who makes a purchase (hereinafter referred to as "the Customer").

2.2 These terms and conditions are the only valid and supersede all other terms and conditions, except by prior, written modification by the baby's corner.

2.3 To place an order, the customer must be at least 18 years old. If the customer is not 18 years old, parental or legal guardian consent is required. the baby's corner may refuse orders from minors.

2.4 The customer accepts the general conditions of sale by validating the order, having read and approved them.

2.5 For online purchases, any additional special terms and conditions also apply. If these conflict with the general terms and conditions, the most advantageous terms and conditions for the customer shall apply.

article 3 - the order 

3.1 If an offer has limited validity or is subject to specific conditions, this will be clearly stated.

3.2 Orders from the baby's corner can be placed in three ways:

• Online: The customer adds products to the shopping cart, fills in contact and billing information, chooses delivery and payment method, and accepts the terms and conditions. After payment, the customer receives a confirmation email.
• In-store: The customer selects items, makes a dream list and comes to the store. If not in stock, they are ordered.
• By e-mail or phone: Customer contacts for assistance with order.

3.3 The order is final after email confirmation by the baby's corner and approval of payment by the card issuer.

3.4 Large orders are possible but stocks are not always sufficient. The customer will be informed about this.

3.5 An order is invalid if the customer's permanent place of residence or domicile cannot be determined. The baby's corner may request necessary data in this case.

article 4 - right of withdrawal 

4.1 The customer has the right to return goods 14 days after delivery without payment of any penalty and without giving any reason. Return shipping costs are the responsibility of the customer.

4.2 Upon receipt, products must be inspected immediately due to possible shipping damage.

4.3 The direct costs of return shipment shall be borne by the customer.

4.4 Refunds will be made within 30 days of receipt of the return by the baby's corner.

4.5 During the first 14 days after delivery, the customer may only unpack or use the goods as necessary to assess whether he wishes to keep them.

4.6 Returns can be made by mail, courier or in the store in Nazareth and Hasselt.

4.7 The right of withdrawal must be notified via hello@babyscorner.be stating the order number and customer details.

4.8 Exclusion of the right of withdrawal applies to specific products and gift vouchers.

article 5 - prices 

5.1 Sales prices on the site are in euros and include all taxes, VAT and duties. Shipping costs are exclusive and will be added at the end of the order.

5.2 Prices may change, but the valid price is that at the time of order.

5.3 In case of incorrect pricing, the order will be canceled and the customer will be refunded the amount paid.

article 6 - payment

6.1 Payment can be made by Bancontact, MasterCard, Visa, PayPal or bank transfer.

6.2 Payment is final upon approval by the card issuer.

6.3 If payment is refused by the card issuer, the order will be cancelled.

6.4 The baby's corner retains ownership until full payment of the order.

article 7 - delivery 

7.1 Delivery takes place upon receipt of payment, unless otherwise agreed.

7.2 The estimated delivery time is listed on the site. In case of delay, the customer will be informed.

7.3 If a product is out of stock, the customer will be informed of the expected delivery time.

7.4 Deliveries are made by external partners. The risk passes to the customer upon delivery.

7.5 In the event of incorrect delivery or shipping damage, the customer must notify hello@babyscorner.be within 48 hours .

7.6 In the absence of delivery, the carrier will leave a message for a new delivery date or instructions for pickup.

7.7 The baby's corner is not liable for loss or damage during shipment.

7.8 Collection from the store is possible within the specified opening hours.

7.9 In case of non-deliverable products, the customer will be informed and refunded.

article 8 - warranty and conformity 

8.1 The baby's corner guarantees that products comply with the agreement and are free of defects.

8.2 Warranty is the manufacturer's factory warranty.

8.3 Complaints about visible defects must be reported within 48 hours of receipt.

8.4 In case of complaints or defects, the customer shall contact hello@babyscorner.be.

8.5 The customer retains all legal rights to conformity and warranty.

article 9 - liability 

9.1 The baby's corner is not liable for indirect damages, loss of profits or loss of data.

9.2 Liability is limited to the price of the product ordered.

9.3 The customer is liable for incorrect data in the order.

article 10 - force majeure 

10.1 The baby's corner is not liable for delays or failures due to force majeure.

10.2 In the event of force majeure, obligations are suspended. In case of permanent force majeure, the agreement may be dissolved without compensation.

article 11 - privacy 

11.1 Personal data will be kept confidential and not passed on to third parties.

11.2 The customer has the right to access, correct and delete their data.

article 12 - intellectual property 

12.1 The content of the website is protected by intellectual property rights.

12.2 It is prohibited to copy, distribute or use the content without permission.

article 13 - applicable law and disputes 

13.1 Belgian law is applicable to this agreement.

13.2 In case of disputes, the court of Ghent shall have jurisdiction.

article 15 - complaint handling and disputes

15.1 The baby's corner is committed to complete satisfaction of all its customers. However, should a customer have any suggestions or comments regarding the services of the baby's corner, the customer may contact hello@babyscorner.be. The baby's corner is committed to responding to emails within 2 business days.

15.2 All agreements between the baby's corner and customers, regardless of their place of residence, are governed exclusively by Belgian law. Exclusive jurisdiction for disputes lies with the Belgian courts of the judicial district in which the registered office of the baby's corner is located. This also applies to individuals, who expressly accept this by accepting the general terms and conditions.

article 16 - processing of personal data

16.1 The baby's corner uses personal data to provide services, understand your needs and interests, complete transactions or orders, communicate with you, provide support, notify you of services and benefits, and create customized offers and specific the baby's corner websites. Your information may also be used for market research regarding products or services provided by the baby's corner. You may set privacy preferences regarding such communications. Credit card information is used only for payment processing and fraud prevention, not for other purposes, and is not kept longer than necessary.

16.2 Personal data collected online may be combined with data you provide through other sources, such as product registration, call centers or public events.

16.3 Non-personal data is aggregated for reporting on the usability, performance and effectiveness of the baby's corner websites, for the purpose of improving user experience and site content.

16.4 The baby's corner is committed to up-to-date personal data and has implemented technology, management procedures and policies to accurately track customer data. You can access and modify your data online with required identity verification.

16.5 For viewing and changing personal data, the web page where the data was entered is the most convenient place, where you can follow the instructions on that page.
